Welcome to Cognix Health! These Terms of Service govern your access to and use of our behavioral health operations SaaS web application and any related services provided by Cognix Health.
1. Acceptance of Terms
By accessing or using our services, you agree to these Terms of Service and our Privacy Policy. If you do not agree to these terms, you may not access or use our services.
2. Description of Services
Our services include access to our behavioral health operations SaaS web application, which is designed to streamline operations for behavioral health organizations. We may also offer additional services or features from time to time, which will be subject to these Terms of Service.
3. User Accounts
In order to access certain features of our services, you may be required to create a user account. You are responsible for maintaining the confidentiality of your account credentials and for any activity that occurs under your account. You agree to notify us immediately of any unauthorized access to or use of your account.
4. Use of Services
You agree to use our services only for their intended purposes and in compliance with all applicable laws and regulations. You may not use our services in any manner that could interfere with the operation of our platform or infringe upon the rights of others.
5. Intellectual Property
All content and materials available through our services, including but not limited to text, graphics, logos, and software, are the property of Cognix Health or its licensors and are protected by copyright and other intellectual property laws. You may not use, reproduce, or distribute any of these materials without our prior written consent.
6. Privacy
Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and disclose information about you when you access or use our services.
7. Data Security
We implement industry-standard security measures to protect your data. This includes encryption, secure data transmission, and regular security audits. However, no method of transmission over the Internet or electronic storage is 100% secure, and we cannot guarantee absolute security.
8. HIPAA Compliance
Our services are designed to be HIPAA-compliant. Users are responsible for their own HIPAA compliance when using our services. We provide the tools and features necessary to maintain HIPAA compliance, but proper use of these features is the responsibility of the user.
9. Service Availability
While we strive to provide uninterrupted service, we do not guarantee that our services will be available at all times. We may occasionally need to perform maintenance or updates that could temporarily affect service availability.
10. Changes to Terms
We reserve the right to modify or update these Terms of Service at any time, in our sole discretion. We will notify you of any changes by posting the revised terms on our website. Your continued use of our services following the posting of any changes constitutes acceptance of those changes.
11. Cognix Fieldwork Subscriptions
Cognix Fieldwork is an individual fieldwork ledger for trainees pursuing BCBA or BCaBA certification. A Fieldwork account belongs to the trainee, not to a practice, and these subscription terms apply to the trainee directly. Fieldwork is free for as long as you work at a practice that uses Cognix Health. If you leave, everything stays free for 60 days; after that, a paid plan is needed to keep using the app. Downloading all of your records is always free, and nothing is deleted when a plan ends.
12. Fieldwork Plans, Prices and Automatic Renewal
The Personal plan is $9.99 a month or $99 a year and keeps you adding hours, signing monthly forms and using the planner. The Archive plan is $2.99 a month, $29 a year, or $149 once for 7 years, and keeps read access to every entry and signed form. Prices are in US dollars and exclude any taxes that may apply. Monthly and yearly plans renew automatically at the end of each billing period, at the price then in effect, until you cancel. The one-time 7-year Archive purchase does not renew. We will give you notice by email before a renewal at a changed price.
13. Fieldwork Free Trial
New Personal subscriptions may start with a free trial of up to 14 days. A trial is available once per account, only on the Personal plan, and only to trainees who sign up directly rather than arriving from a Cognix Health practice. Payment details are collected when the trial starts, and the plan converts to paid automatically at the end of the trial unless you cancel before it ends. Stripe sends a reminder before a trial ends.
14. Cancelling a Fieldwork Subscription
You can cancel at any time from Plan and billing in the app, which opens the billing portal. Cancellation takes effect at the end of the billing period you have already paid for, and you keep full access until then. Payments already made are not refunded except where the law requires it; if something has gone wrong with a charge, contact us and we will put it right. When a subscription ends, your account becomes read-only: your records are kept, and downloading them stays free.
15. Fieldwork Records and the Seven-Year Archive
The Behavior Analyst Certification Board asks trainees and supervisors to keep fieldwork documentation for at least seven years. When a month is signed and locked, Cognix Health writes a copy of its Month Summary, the signatures and a manifest to storage that cannot be changed or deleted for seven years. Your working records remain in your account for as long as it exists, and you can download everything at any time. Payments are processed by Stripe; Cognix Health does not receive or store your card details.
16. Contractual Obligations
During the onboarding process, a Master Service Agreement and a Business Associate Agreement will be provided for your signature..
